IRISH DATA PROTECTION LAW STUDY RECOMMENDS BREACH NOTIFICATION

The Data Protection Review Group, an initiative by the government of Ireland to examine the country’s data protection laws, has recommended the creation of a national data breach notification law. Such laws are spreading fast, having first appeared in the state of California more than 5 years ago. As the result of these laws tens of thousands of breaches have been reported, leading many to believe that data breaches are happening at an alarming rate everywhere. The problem is that in jurisdictions without such laws data breaches go unreported and unpunished.

Data breach notification laws are considered one of the driving forces behind the dramatic increase in the use of secure destruction services in the US and will likely have the same result elsewhere as they spread.

The study also recommended stiff prosecution of data controllers that recklessly disregard the protection of personal information.
