DOCTORS LIABLE FOR EMPLOYEE BREACH

A recent article on the Modern Medicine website by David Goldberg, M.D., J.D. a doctor, researcher and lawyer, reminds doctors that they are a liable for HIPAA violations.  The article describes the genesis of the responsibility to protect the Protected Health Information, doctors’ ultimate responsibility, how employees can compromise PHI when untrained and the penalties.  This is just one more market indication, supporting NAID’s development of a marketing strategy aimed at such professionals.
 
Inexplicably, however, the article does not touch on the fact that the doctor would have also been subject to health data breach notification provision of HIPAA/HITECH.  Don’t worry, though, we won’t forget to remind them.
